1. Acceptance of these Terms
These Terms of Use (“Terms”) govern access to this website and the general inquiry and advertising-request features provided by America Welcome Inc. (“America Welcome,” “we,” “us,” or “our”). By using the website or submitting a form, you agree to these Terms and our Privacy Policy.
If you enter into a separate written advertising agreement with America Welcome, that agreement controls the paid advertising services and will prevail if it directly conflicts with these Terms.
2. America Welcome’s limited role
America Welcome does not:
- Represent buyers, sellers, owners, landlords, tenants or real estate professionals.
- List, value, sell, purchase, rent or lease real property.
- Recommend one property or professional over another.
- Qualify prospective buyers or determine financial eligibility.
- Schedule or conduct property showings.
- Negotiate price, terms, commissions or contracts.
- Prepare offers, legal documents or closing materials.
- Participate in a transaction or receive transaction-based compensation.
A legal owner may advertise and sell their own property, subject to applicable law. A Realtor or broker may submit a property only when properly licensed and authorized to advertise it.
3. Advertiser responsibilities
Every owner, Realtor, broker or other advertiser submitting property information represents and warrants that:
- They are the legal owner or have valid authority from the owner, listing brokerage and any other required party.
- The submitted information is accurate, current and not misleading.
- They have all rights and permissions needed to use and authorize the photographs, videos, plans, trademarks and other materials supplied.
- The advertisement and property are offered in compliance with federal, state and local law, fair-housing requirements, licensing rules, brokerage policies, MLS rules and advertising-platform policies.
- They will promptly report material changes in price, availability, representation or authorization.
America Welcome may refuse, suspend, correct or remove advertising that appears inaccurate, unauthorized, unlawful, discriminatory or inconsistent with these Terms.
4. Property inquiries
When a visitor asks about a specific property or opportunity, America Welcome receives the inquiry and forwards it to the owner or licensed real estate professional who purchased or authorized the applicable advertising space.
America Welcome performs this forwarding as an administrative advertising function. We do not evaluate, select, verify or qualify the person submitting the inquiry. The recipient is solely responsible for responding and for all later communications, disclosures, showings, negotiations and transactions.
If a visitor selects several properties, the visitor’s information may be sent separately to each applicable advertiser, as described in the Privacy Policy and the consent shown with the inquiry form.
5. Fixed advertising fees
America Welcome is compensated only through fixed fees for advertising, content, campaign management and related marketing services. Fees, campaign duration, media budget, cancellation rules and deliverables will be stated in a separate proposal or advertising agreement.
America Welcome does not receive real estate commissions, referral fees, compensation per inquiry or compensation based on a sale, purchase, lease, closing or property value. Website use alone does not obligate either party to purchase services.
6. Property and professional information
Property information is supplied by independent owners or real estate professionals. America Welcome does not independently verify ownership, title, licenses, measurements, boundaries, price, availability, condition, zoning, permits, construction feasibility, projected returns or other claims.
Information is believed reliable when supplied but is not guaranteed and may change without notice. Images identified as representative are not advertisements for a specific available property. Users must independently verify material information and obtain appropriate licensed real estate, legal, tax, financial, architectural, engineering or construction advice.
No content on the website is an offer, contract, appraisal, investment recommendation or guarantee of availability.
7. Acceptable use
You may not use the website to:
- Submit false, misleading, unauthorized or discriminatory information.
- Impersonate another person or misrepresent ownership, licensure or authority.
- Collect information about other users without permission.
- Transmit malicious code, spam or unlawful material.
- Interfere with the website’s security, availability or operation.
- Copy or exploit website content except as permitted by law or written authorization.
8. Intellectual property
The website design, America Welcome branding, original text, graphics and other content created by America Welcome are owned by America Welcome Inc. or used with permission. Property materials remain owned by their respective owners or licensors.
By submitting materials for advertising, the advertiser grants America Welcome a nonexclusive, worldwide, royalty-free license to reproduce, format, adapt and display those materials solely to review, prepare and deliver the requested advertising services. This license ends when no longer reasonably needed for those purposes, subject to archival and legal-record requirements.
9. Third-party services
Links to listings, brokerages, social networks, architects, builders and other third parties are provided for convenience. America Welcome does not control or endorse every third-party service and is not responsible for its content, availability, privacy practices or performance. Each professional remains independent and responsible for their own services.
10. Disclaimers and limitation of liability
THE WEBSITE AND GENERAL INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE,” TO THE MAXIMUM EXTENT PERMITTED BY LAW. AMERICA WELCOME DOES NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, A PARTICULAR NUMBER OR QUALITY OF INQUIRIES, OR ANY SALE, PURCHASE, LEASE OR OTHER RESULT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICA WELCOME WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST PROFITS, LOST OPPORTUNITIES, OR DAMAGES ARISING FROM A REAL ESTATE TRANSACTION, THIRD-PARTY CONDUCT OR INACCURATE ADVERTISER-SUPPLIED INFORMATION.
Nothing in these Terms excludes liability that cannot legally be excluded. Rights provided by applicable consumer law remain unaffected.
11. Indemnification by advertisers
To the extent permitted by law, an advertiser agrees to defend and indemnify America Welcome from third-party claims arising from materials the advertiser supplied, lack of authority to advertise, inaccurate representations, discriminatory or unlawful advertising, or the advertiser’s real estate services or transaction conduct. Any separate advertising agreement may contain additional terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise. Subject to any non-waivable rights, disputes concerning these Terms or the website will be brought in the state or federal courts with jurisdiction in Pinellas County, Florida.
13. Changes, severability and entire terms
We may update these Terms by posting a revised version and changing the “Last updated” date. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law. If any provision is unenforceable, the remaining provisions remain in effect. These Terms and the Privacy Policy form the general agreement for website use, subject to any separate written advertising agreement.
14. Language versions
Translations are provided for convenience. If a translated version differs from the English version, the English version controls to the extent permitted by applicable law.
